BOSTON – Massachusetts Attorney General Andrea Joy Campbell announced today that she and 12 other Attorneys General have filed a lawsuit challenging Elon Musk’s exercise of executive power.
The lawsuit claims that President Trump violated the United States Constitution by establishing a new federal department without congressional approval and granting Musk broad authority over the entire federal government without seeking Senate advice and consent.
“The President cannot create a new department to restructure the federal government and certainly cannot give unchecked power to a billionaire friend without Congressional action,” according to Attorney General Campbell.
“Our lawsuit seeks to put an end to the ongoing corruption and abuse of power at DOGE that threatens funding for crucial needs such as healthcare, education, and more.”
The lawsuit accuses Musk of dismantling federal agencies, gaining access to sensitive data, and causing widespread disruption for state and local governments, as well as the American public.
The complaint also claims that Musk’s actions violate the Appointments Clause of the United States Constitution, which requires that executive appointments be confirmed by the Senate and that those nominated make comprehensive and public financial disclosures to avoid conflicts of interest.
AG Campbell seeks a court ruling declaring Musk’s actions unconstitutional and an injunction prohibiting him from issuing orders to anyone in the Executive Branch other than DOGE, as well as invalidating his previous actions.
The attorneys general of California, Connecticut, Hawai’i, Maryland, Minnesota, Nevada, Oregon, Rhode Island, Washington, and Vermont have joined AG Campbell in filing this lawsuit, which was led by the New Mexico Department of Justice and the attorneys general of Arizona and Michigan.
